U.S. CPSC Mandatory eFiling Takes Effect July 8, 2026: What Importers and Brand Owners Must Do Now

 

Xiamen, ChinaMay 2026 — The U.S. Consumer Product Safety Commission (CPSC) has finalized its mandatory eFiling rule, effective July 8, 2026. From that date forward, all regulated consumer products entering the United States must have their Certificate of Compliance (CoC) data submitted electronically via the Automated Commercial Environment (ACE) at the time of entry.

This marks the end of the voluntary pilot phase and the beginning of real-time, mandatory digital compliance. For brands and importers, the margin for paperwork error is now effectively zero.

 

What Changed?

Previously, CoC documentation could accompany shipments in paper or PDF format, with some flexibility in timing. Under the new final rule:

    • Electronic submission is mandatory. CoC data must be filed through ACE before customs clearance.
    • Real-time matching. CPSC and U.S. Customs and Border Protection (CBP) will cross-check product data at entry. Discrepancies or missing certificates can trigger holds, inspections, or cargo delays.
    • Broader product scope. The rule covers regulated consumer products under CPSC jurisdiction—this includes toys, children’s products, bags with painted or metal components, promotional items, and any goods subject to ASTM or CPSIA standards.

The Commission’s stated goal is to reduce cargo delays and improve safety surveillance. In practice, however, importers who are unprepared face the greatest risk of port congestion and missed delivery windows.

 

What This Means for Your Brand

If you are a U.S. importer, distributor, or brand owner sourcing bags and consumer goods from overseas, the new rule introduces three immediate operational requirements:

  1. Pre-arrival documentation readiness Your CoC must be complete, accurate, and digitally filed before the container hits the port. There is no longer a "fix it later" window. 
  2. Traceability from factory to border CPSC eFiling requires detailed product identifiers—model numbers, SKU logic, material specifications, and test-report citations. If your factory records are fragmented or inconsistent with your import declarations, ACE submissions will fail validation.
  3. Third-party testing alignment The CoC must cite valid third-party test reports (for example, CPSIA lead/phthalate testing for children’s products or Prop 65 compliance for California-bound goods). Test reports must match the actual production lot, not just a generic material swatch from two years ago.
